Tentative Ruling
Defendant Nationwide Investment Advisors, LLCs (Defendant) Motion to Compel Further Responses to its Special Interrogatories, Set One (SIs) is UNOPPOSED[1] and GRANTED.
Defendant served in pro per Plaintiff Thomas M. Bates (Plaintiff) with the SIs on January 6, 2025. (Decl. of Bradley C. Carroll ISO Mot. (Carroll Decl.) ¶ 6, Ex. 1.) Plaintiff responded to the SIs on February 7, 2025. (Id. at ¶ 7, Ex. 2.) After meeting and conferring concerning Plaintiffs Responses, Defendant filed the instant motion to compel further responses to SIs 1-15 and 20-22. (Id. at ¶¶ 8-15, Exs. 3-8.)
No opposition to the motion has been filed. A partys failure to oppose a motion is construed as a concession on its merits. (See D.I. Chadbourne, Inc. v. Super. Ct. (1964) 60 Cal.2d 723, 728, fn.4.)]
Plaintiff shall serve verified, Code-compliant further written responses, without objections, to SIs 1-15 and 20-22 no later than July 11, 2025.
Defendant shall provide notice of this ruling to Plaintiff and file proof of service of same within five (5) calendar days.
The minute order is effective immediately. No formal order pursuant to California Rules of Court, rule 3.1312 or further notice is required.
[1] The Court declines to consider Plaintiffs Notice of Opposition of Defense Request to Compel Further Responses to Special Interrogatories, Set One, which was untimely filed on June 2, 2025. Any opposition to this motion was due to be filed no later than May 28, 2025. (See Code Civ. Proc., § 1005, subd. (b) [All papers opposing a motion . . . shall be filed with the court and a copy served on each party at least nine court days . . . before the hearing.];

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.
Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away.
