The parties are to appear to address status of scheduling corporate representative depositions. As discussed at the August 4 conference, Plaintiffs' motion now seeks sanctions against the following two defendants: (1) Merck & Co., Inc. ("Merck"); and (2) PTI Union, LLC. Merck filed a substantive opposition which demonstrates its attempts to schedule a deposition.

PTI Union also filed a response on July 24, citing its motion to quash which was denied by this court on March 24. PTI Union's writ petition was denied in a substantive order by the Court of Appeal on June 24, and PTI Union petitioned the California Supreme Court for review on July 6, which remains pending. The parties should be prepared to discuss whether there is a stay or if the Court of Appeals order is a "final judgment in the mandate proceeding" for purposes of section 418.10(c) of the Code of Civil Procedure.

In addition to providing updated status, before the August 5 hearing counsel shall obtain dates for deposition of their corporate representative(s) between August 6 and August 21. If the parties have not agreed on a deposition date, the court will order deposition dates for each witness at the hearing as appropriate.
