The parties' are to appear to address status of scheduling corporate representative depositions. Plaintiffs' motion seeks sanctions against nine Defendants, but their August 3, 2026 Case Management Statement states that the motion remains pending with respect to the following three defendants: (1) Calvin Klein Cosmetics; (2) PTI Union, LLC; and (3) Merck & Co. ("Merck"). Merck filed a substantive opposition which demonstrates its attempts to schedule a deposition.

PTI Union also filed a response on July 24, citing its motion to quash which was denied by this court on March 24. PTI Union's writ petition was denied in a substantive order by the Court of Appeal on June 24, and PTI Union petitioned the California Supreme Court for review on July 6, which remains pending. Accordingly, Plaintiffs' motion is denied as premature with respect to PTI Union. (Cal. Code Civ. Proc. § 418.10(c).)

In addition to providing updated status, before the August 5 hearing counsel for Calvin Klein Cosmetic and Merck shall obtain dates for deposition of their corporate representative(s) between August 6 and August 21. If the parties have not agreed on a deposition date, the court will order deposition dates for each witness at the hearing.
