23CV034370: BOWMAN vs MORALES 08/06/2026 Order to Show Cause Re: Dismissal Per CRC 3.1385 in Department 22
Tentative Ruling - 07/22/2026 Han N. Tran
The Court orders the following after review of the case.
A Notice of Settlement was filed on 6/9/26.
A request for dismissal has not been filed even though over 45 days have passed. On 6/10/26, the Court set an Order to Show Cause to dismiss this action if Plaintiff does not do so.
Neither party filed a declaration or response to the Order to Show Cause. As such, no cause has been shown why the Court should not dismiss this action pursuant to Rules of Court, rule 3.1385.
Any delay in performance of the settlement agreement or any delay in payment or installment payment arrangements of settlement funds does not preclude dismissal without prejudice because the Court retains jurisdiction to enforce the settlement.
Pursuant to Rules of Court, rule 3.1385(b), (c), this case is DISMISSED WITHOUT PREJUDICE, subject to the court retaining jurisdiction to enforce the settlement pursuant to Code Civ. Proc. § 664.6(e).
Clerk is directed to serve copies of this order, with proof of service, to counsel and to selfrepresented parties of record.
