Plaintiffs Eyner Morales Chavez and Antonio Hernandezs Motion for Preliminary Approval of the Class and PAGA Settlement is granted in part.
I.
Background
The Court assumes the readers familiarity with its prior order continuing the hearing on this Motion. (See Order Continuing Mot. Preliminary Approval Class & PAGA Settlement, June 3, 2026.) In short, the Court continued the hearing to permit the parties time to revise the scope of the PAGA release, provide a summary on the first page of the class notice, translate the class notice to Spanish if appropriate, and provide a proposed hearing for the motion for final approval. (Id. at 23.)
In response to the Courts order, the parties revised the scope of the PAGA release to cover any and all claims which were alleged in the Chavez PAGA Letter or Hernandez PAGA Letter, and set forth in the Operative Complaint, arising during the PAGA Period, for civil penalties . . . . (Young Suppl. Decl. Supp. Mot. Preliminary Approval Class & PAGA Settlement Ex. C, at ¶ 1.gg, July 20, 2026; see also id. Ex. A (showing changes to PAGA release).) The parties also included the requested summary on the first page of the class notice. (Id. Ex. D; see also id. Ex. B (showing changes to class notice).) The parties also agreed to provide notice in Spanish. (Id. ¶ 4.) The parties requested a hearing for the motion for final approval on November 11, 2026, which is a federal holiday. (Id. ¶ 8.)
II.
Discussion
The Court grants the Motion. First, the Court previously found that [t]he terms of the settlement and notice procedures appear generally fair, reasonable, and adequate. (Order at 2.) The Courts sole concern with the proposed settlement was the scope of the PAGA release. Having reviewed the release, the Court now approves of the parties revised definition of the Released PAGA Claims. Second, the Court now finds that the revised class notice as the revised notice is clear and will adequately inform class members of the nature of this action and the proposed settlement. The parties decision to provide notice in Spanish will ensure that more class members have the opportunity to understand their rights and make an informed decision concerning the proposed settlement.

III. Orders The Motion is granted in part.
