3. DELEON VS. GASCO 2024-01417080 MOTION TO COMPEL DEPOSITION (ORAL OR WRITTEN)

The unopposed motion of defendant Rosmar Rodriguez Gasco for an order compelling plaintiff Carlos Alberto Castillo Deleon to appear for deposition is GRANTED.

Plaintiff is to appear for deposition at a mutually convenient date within 25 days of service of the notice of ruling. The Court GRANTS a monetary sanction of $1905 to defendant against plaintiff and his attorneys of record payable within 25 days of service of the notice of ruling. The Court DENIES defendant’s request for a statutory penalty of $500 under Code Civ. Proc. § 1992 because it is not applicable, i.e., a deposition notice is neither a subpoena nor a court order.
