Motion to Quash is set for hearing on January 22, 2026. It should not have been taken off September 12, 2025 calendar and should have been continued to be heard with the Motion to Compel Turnover of Funds. Motion to Quash is Denied.
Motion to Compel Turnover of Funds was personally served on Mr. Olives and sub-served on Mr. Mollica per the proofs of service filed on September 30, 2025. The Court notes that by the time the Motion to Compel Turnover was heard on November 19, 2025, Motion to Quash was stale as it was filed months before the service reflected in the September 30, 2025 proofs of service.
Any issues with jurisdiction could have been and were addressed in the October 27, 2025 Opposition to the Motion to Compel Turnover of Funds. Those arguments have been considered in the Court's ruling. Motion for Reconsideration of the order on the Motion to Compel Turnover of Funds is Denied. =(501/CFH)
