NOTICE:

A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.

TENTATIVE RULING:
Plaintiff Wells Fargo Bank, N.A. (Plaintiff) has stated the incorrect address for the hearing in its Notice of Motion. The correct address for Department 53 of the Sacramento County Superior Court is 813 6th Street, Sacramento, California 95814. Plaintiff shall notify opposing party immediately.
Plaintiffs motion to deem matters admitted is UNOPPOSED and GRANTED as explained herein.
Plaintiff served Defendant with Requests for Admissions, set one (RFAs) by mail on October 28, 2024. No response has been provided.
No opposition to this motion was filed. A partys failure to oppose a motion is construed as a concession on the merits of the motion. (See D.I. Chadbourne, Inc. v. Superior Court (1964) 60 Cal.2d 723, 728, fn.4.)
The matters specified in the RFAs are deemed admitted unless Defendant Wilene K. Sanders (Defendant) serves, before the hearing on the motion, proposed responses to the RFAs that are in substantial compliance with Code of Civil Procedure section 2033.220. (Code Civ. Proc., § 2033.280, subd. (c).)
Plaintiff has expressly waived all sanctions that may be awarded by the Court. (See Not. of Mot. & Mot. 1:28.)
