Cross-Defendant's Motion for Summary Judgment/Adjudication is DENIED.
Summary Judgment is denied pursuant to California Code of Civil Procedure section 437c(c) as there are triable issues of material facts that exist as to Undisputed Material Facts Nos. 4, 6, 7, and 9 in Defendant BACS' Separate Statement. These disputed facts concern the scope of Defendant BACS' responsibilities under its contract with the City and County of San Francisco and bear directly on the existence and scope of any duty of care owed to Plaintiff.
