TENTATIVE RULING:
APPEARANCES ARE NOT REQUIRED. The Court previously granted the Guardianship/SIJF petition ex parte. Since the granting of the petition, the ward has turned 21 years old, and the guardianship has terminated by operation of law. The case is DISMISSED.
9. Guardianship of Tyler Vincent Mellone, Thea Lilly Mellone SPR09713 Termination of Guardianship
TENTATIVE RULING:
APPEARANCES ARE NOT REQUIRED. The parties are directed to review Local Rules 6.2.F. which requires, among other things, that parties meet and confer for purposes of making reasonable efforts to informally resolve any controversies and to file Statements of Issues or Settlement prior to an evidentiary hearing. The matter is CONTINUED to August 18, 2026, at 9:30 a.m. in Dept.
61. Each party is to file their Statement of Issues or Settlement with the court no later than August 11, 2026, one week prior to the next court date. All parties should also be prepared to identify a reasonable date for the exchange witness lists and documents (if any) which he/she/they intend to submit for the Court’s consideration at the evidentiary hearing. The Court, on its own motion, will appoint counsel for the minor wards, the selection of which will occur prior to the next court date. Minor’s Counsel will be ordered to appear at the next court date should the matter not resolve by way of agreement.
The Court notes that since the inception of the guardianship, the Guardian has not filed the required annual Guardian Status Report (GC-251) form. The Guardian is directed to file the Confidential Guardianship Status Report, GC-251, no later than August 18, 2026, and annually thereafter. (Form GC-251 is available at the following URL: https://www.courts.ca.gov/forms.htm). If the Guardian is unable to meet this requirement, the Guardian may ask to address this issue at the next court appearance on that same date and explain why additional time is needed. Further advisements which are not part of tentative ruling: If any objections are filed at or before the time of hearing, the Court will not adopt the tentative ruling and will, instead, set the matter for a contested hearing and the parties will be notified by the Court as to when they should next appear.
