Petition for Termination of Guardianship
CASE NUMBER: 25PG-0032904 This matter is on calendar for further proceedings on a Petition for Termination of Guardianship filed by the mother, Nicole Scruggs. A new Notice of Hearing has been filed for today’s date; however, the proofs of service for Matthew, Danielle, the father of Matthew, the maternal grandparents, the paternal grandparents of Matthew, the paternal grandmother of Stephanie and Danielle, and the sibling Lillian filed on June 29, 2026, indicate service was untimely. There is no valid proof of service of the Notice of Hearing and Petition for Matthew, Stephanie, the father of Matthew, the father of Stephanie and Danielle, the maternal grandparents, the paternal grandparents of Matthew, the paternal grandparents of Stephanie and Danielle, and siblings Alexis, Samantha, and Lillian.
Insufficient information has been provided to permit the Court to dispense with notice to these parties. These individuals must be served at least 15 days before the hearing and may be served by mail. Probate Code § 1460.
This matter is also on calendar for confirmation of counsel. The Court has reviewed the Court Investigator’s report filed on June 2, 2026, which raised concerns regarding the guardianship. Melissa Fanoe has been appointed as counsel for the minors.
The matter is continued to Monday, August 10, 2026, at 8:30 a.m. in Department 42 for further proceedings on the Petition for Termination for Guardianship. Petitioner is required to file and serve a new Notice of Hearing for the continued hearing date, along with a copy of the Petition, on the parties identified above. In the alternative, if Petitioner cannot serve the parties identified, the Court will require a declaration explaining in detail all efforts of Petitioner to locate and serve them and why they cannot be served, to permit the Court to dispense with notice. An appearance is necessary on today’s calendar to confirm counsel for the minors and discuss the Guardianship’s status.
