Defendant General Motors LLC (“Defendant” or “GM”) brings this Motion to Continue Trial and All Related Dates (the “Motion”), seeking a continuance of eight (8) months (240 days) from the originally set trial date of January 6, 2026, to allow its Motion for Summary Judgment/Adjudication (“MSJ”) to be heard at least 30 days before trial. (Motion at 2:3-11.)
GM brings the Motion on the grounds that an unforeseen delay in obtaining essential documents from Plaintiff Bathena Dixon (“Plaintiff”) prevented GM from timely filing its MSJ. Specifically, GM required the purchase contract to prepare and file the MSJ and did not receive it from Plaintiff until shortly before filing. As a result, GM was unable to file its MSJ until December 10, 2025. The Court (Judge Vincent I. Parrett) heard and ruled on GM’s MSJ on July 15, 2026 and his written order was filed on July 16, 2026.
The Court (Judge Vincent I. Parrett) has already entered an exparte order dated and filed December 15, 2025 that:
1. Trial Assignment Conference currently set for December 18, 2025, at 1:30 pm is continued to September 26, 2026 at 1:30 PM in Dept. 18; and 2. Trial currently set for January 6, 2026, at 8:45 a.m., is continued to September 21, 2026 at 8:45 AM in Dept. 18.
3. All parties and all counsel are hereby put on Notice that there will be no further continuance of this trial.
No good cause appearing, the Motion is DENIED. The dates remain as set by Judge Parrett’s order dated and filed December 15, 2015.
