Motion – Set aside/vacate
The motion to set aside default, purportedly brought by “Defendant In Pro Per” Garlo LLC, is hereby STRICKEN as it was not drawn or filed in conformity of the laws of this state. (Code Civ. Proc., § 436 subd. (b).) In California, a corporation must be represented by a licensed attorney in legal proceedings. (CLD Construction, Inc. v. City of San Ramon (2004) 120 Cal.App.4th 1141, 1146.) Here, the motion is purportedly brought by “Garrett Wood, Authorized Representative of Garlo LLC.” According to the State Bar, there is no individual by that name licensed as an attorney in the State of California.
All parties must comply with Marin County Superior Court Local Rules, Rule 2.10(B) to contest the tentative decision. Parties who request oral argument are required to appear in person or remotely by ZOOM. Regardless of whether a party requests oral argument in accordance with Rule 2.10(B), the prevailing party shall prepare an order consistent with the announced ruling as required by Marin County Superior Court Local Rules, Rule 2.11.
