LUNA) 11) 12 ORDER TO SHOW CAUSE AND AFFIDAVIT FOR CONTEMPT 13 TENTATIVE RULING 14 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 15 Court makes the following findings and orders: 16 A. Procedural History 17 1) The parties are Petitioner Brett Lamy and Respondent Liana DiMauro. 18 2) On June 2, 2026, Respondent filed an Order to Show Cause and Affidavit for Contempt alleging 19 one count of contempt for failure to pay court ordered attorney fees. 20 3) On June 29, 2026, Respondent filed a Proof of Personal Service of the Order to Show Cause and 21 Affidavit for Contempt. 22 B.
Findings and Order 23 1) The Court reviewed the underlying order issued on March 3, 2026 awarding $30,000.00 in 24 attorney’s fees payable by Petitioner to Respondent, which the Court notes does not impose a 25 payment deadline for Petitioner to pay the $30,000.00 to Respondent. 26 2) Given no actual deadline for payment was ordered, Petitioner is not (and cannot possibly be) in 27 contempt of the existing order. 28 3) As such, the Order to Show Cause and Affidavit for Contempt filed June 2, 2026 is hereby 29 DISCHARGED as it is clear, on its face, that Petitioner has not violated the Court’s order.
1 4) No appearances are required on July 16, 2026. 2 5) Counsel for Respondent shall prepare the Findings and Order Regarding Contempt (Family Law) 3 (form FL-415). 4 6) Preparation of Order: If you are directed by the court to prepare the order after hearing – within 5 10 calendar days of the hearing you must either: (a) Serve the proposed order to the other 6 party/counsel for approval, and follow the procedures set forth in CA Rules of Court, Rule 7 5.125(c), or (b) If the other party did not appear or the matter was uncontested, submit the 8 proposed order after hearing directly to the court. Failure to submit the order after hearing within 9 10 days may allow the other party to prepare a proposed order and submit it to the court in 10 accordance with CA Rules of Court, Rule 5.125(d). 11
