LUNA) 11) 12 REQUEST FOR ORDER: MOTION TO BIFURCATE MARITAL STATUS 13 TENTATIVE RULING 14 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 15 Court makes the following findings and orders: 16 A. Procedural History 17 1) The parties are Petitioner Jose Ignacio Perez Barrera (Husband) and Respondent Veronica 18 Jimenez Guitron (Wife).
There are no minor children subject to this proceeding. 19 2) On 5/29/26, Wife filed a Request for Order seeking bifurcation and termination of marital status. 20 3) Wife did not file a Proof of Service Declaration indicating that her 5/29/26 Request for Order was 21 served on Husband. 22 4) Wife’s Request for Order does not include mandatory form FL-315 (Request for Separate Trial). 23 5) Husband did not file a Responsive Declaration. 24 B. Findings and Order 25 1) The Court finds that Wife’s 5/29/26 Request for Order was not served at least 16 Court days prior 26 to the hearing date as required by Code of Civil Procedure section 1005(b). 27 2) The Court further finds that Wife must file mandatory form FL-315 (Request for Separate Trial) 28 before her Request for Order seeking bifurcation and termination of marital status can be 29 adjudicated.
1 3) As such, this matter is continued to 8/19/26 at 9 AM in Department 403. 2 4) At least 16 Court days prior to the next hearing date, Wife shall file form FL-315 (Request for 3 Separate Trial) and serve on Husband the (a) 5/29/26 Request for Order, (b) form FL-315 4 (Request for Separate Trial), (c) Continuance Order contained herein, and (d) Tentative Ruling 5 Instructions using a service method authorized by the Code of Civil Procedure (i.e., a person over 6 the age of 18 shall mail the documents to Husband and then Wife shall file form FL-335 (Proof of 7 Service) with the Court confirming service was effectuated). 8 5) At least 9 Court days prior to the next hearing date, Husband may file a Responsive Declaration. 9 6) At least 5 Court days prior to the next hearing date, Wife may file and serve a Reply Declaration. 10 7) The Court will prepare the Findings and Order After Hearing. 11
