3 - (a) Plaintiff's request for relief from the requirement that he file the SAC by April 24, 2026 is moot; (b) Plaintiff's request to seal the "personal medical portions of the complaint" has been waived by Plaintiff's decision to file the complaint, FAC and SAC without seeking a sealing order; and (c) Plaintiff's motion for leave to amend to add a punitive damages claim is denied without prejudice to renew.
Until Plaintiff is able to present a complaint which establishes a prima facie case for liability against either defendant, and is able to survive demurrer, it is premature to consider whether a claim for punitive damages can properly be stated.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
