Respondent filed a Request for Order (RFO) on March 12, 2026, seeking a motion to compel. Upon review of the Proof of Service, Respondent was mail served some, but not all, of the required documents.
The parties appeared for the hearing on May 7, 2026. Respondent agreed to waive the defect in service. Parties agreed to produce the documents requested in the motion to compel on or before May 21, 2026. The parties agreed to a review hearing and reservation on Petitioner’s request for sanctions.
Respondent filed a Supplemental Declaration on May 26, 2026. There is no Proof of Service for this document.
Petitioner filed a Supplemental Declaration on June 25, 2026. It was served the same day. Petitioner references Respondent’s Supplemental Declaration in his Declaration, as such, the court finds any defect in service to be waived.
Both parties acknowledge that Respondent has not fully complied with the discovery requests. Respondent is now raising objections to complying with the discovery requests.
The court orders parties to appear for the hearing.
