ORDER RE: CASE MANAGEMENT

The Court has ordered the following after review of the case.

PARTIES SANCTIONED FOR FAILING TO COMPLETE MEDIATION

In the TRIAL SETTING ORDER dated JULY 14, 2025, the parties were ordered to complete mediation by JUNE 01, 2026. A CMC was set for JULY 06, 2026, for the express purpose of confirming that mediation had been completed.

Parties indicate that they are actively discussing settlement and have tentatively agreed to mediate in October. The parties have also submitted a stipulation to continue trial - which will be denied without prejudice for lacking good cause. However, the Court will reconsider upon confirmation of setting mediation. That said, the Court will not issue sanctions at this time for failing to mediate pursuant to the current trial setting order.

THE MANDATORY SETTLEMENT CONFERENCE set for AUGUST 06, 2026, at 9am in Dept. 302 IS MAINTAINED.

The parties are reminded that WRITTEN SETTLEMENT CONFERENCE STATEMENTS setting forth a GOOD FAITH ANALYSIS of the facts, the law and a GOOD FAITH OFFER to resolve this case from each party must be emailed directly to dept302@alameda.courts.ca.gov. All trial counsel, parties, and insurance adjusters or others with full settlement authority must participate in person.

The JURY TRIAL date of SEPTEMBER 18, 2026, is MAINTAINED.

The Court is currently conducting fully in person, live jury trials. Please carefully review the TRIAL SETTING ORDER issued in this case and fully comply with its pretrial orders and deadlines. Courtesy copies of all MIL/OPPS and Replies must be delivered to Dept. 520
