2024PRCE024894: IN THE MATTER OF VALERIE M. FAGIANI 06/30/2026 in Department J6 Account and Report
On 9/20/24, the Court ordered the conservator Anita Sharp to serve and file a first account and report by 12/22/25 and set it for a hearing on 2/3/26. The conservator has failed to file the account and report.
At the last hearing on 4/28/26, the Court ordered Ms. Sharp to serve and file a first and final accounting for the period 9/20/24 through 3/3/25 and 3/4/25 through 3/31/26 by 5/28/26 and set the accounting for a hearing this date. (Prob. Code, § 2620.2.) The Court advised Ms. Sharp that the failure to file the account within the time specified, or within 45 days of actual receipt of the notice, whichever is later, shall constitute a contempt of the authority of the court as described in section 1209 of the Code of Civil Procedure. (§ 2620.2, subd. (b).) On 5/6/26, a copy of the minute order was served on Ms. Sharp.
As of 6/24/26, the account has not been filed.
The Court intends to find Anita Sharp in contempt of court. The Court intends to issue a bench warrant for her arrest.
If this case is continued, the mandatory appearance by Anita Sharp is required at the next hearing (appearance via Zoom allowed).
The clerk shall give notice to the conservator, her attorney of record, Guy R. Bayley, and the surety in this case.
