No later than 9:00 a.m. on June 24, 2026 Plaintiffs must file a declaration clearly and unequivocally stating the manner of partition the Plaintiffs are seeking in this action.
Based on the filings before the Court, Plaintiffs appear to claim that (1) Plaintiffs are not seeking partition by sale ("Plaintiffs have not requested partition by sale of any of the properties" (Memorandum of Points and Authorities 8:12-13)); and that (2) Plaintiffs do not believe that partition in-kind is appropriate. (See Memorandum of Points and Authorities 4:24-8:8).
This action will be stayed until Plaintiffs clearly and unequivocally state the manner of partition that is being sought by the Plaintiff. =(501/CFH)
