The Hearing Concerning Disposition of Settlement Proceeds is CONTINUED TO January 14, 2027, AT 9 AM IN THIS DEPARTMENT.
On October 23, 2025, the court granted Plaintiff's Motion for Final Approval of Class Action and PAGA Settlement. The court issued a final judgment. The court issued an order, as well. The order set a "hearing concerning disposition of settlement proceeds" for 6/26/2026. The court further ordered that a declaration of counsel or the settlement administrator re disposition of proceeds be filed "no later than [6/16/2026]," with a courtesy copy delivered to the department by 6/17/2026.
No declaration was filed by 6/16/2026. A declaration of the settlement administrator was lodged for filing almost a week later, on 6/22/2024. No courtesy copy was ever received. Further violations of this courts order will result in sanctions and may result in an OSC commanding personal appearances by counsel, parties and the administrator.
It appears from the late-filed declaration, the only outstanding issue is addressing unnegotiated checks/payments. Plaintiff shall provide declarations accounting for unnegotiated checks/payments and the disposition of these funds to the State Controller, as well as discussing any other outstanding issues that may be discussed at the hearing no later than ten court days before the hearing, with courtesy copy provided to the department within 24 hours of filing. Plaintiff shall lodge a proposed order containing the above text verbatim by email to contestdept302tr@sftc.org prior to the time set for this hearing.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
