The Compliance Hearing Re: Final Distribution scheduled for 07/06/2026 is continued to 07/27/2026 at 02:30 PM in Department 21 at Rene C. Davidson Courthouse.

Counsel for plaintiff has not filed a declaration with an accounting of the settlement funds. The Court sets an OSC why the Court should not impose sanctions of $2000.

The court ORDERS that at least five court days before the continued hearing date the plaintiff must file a statement regarding the status of the distribution including Total funds distributed to class, total checks cashed, total checks not cashed, and residual funds.

The court ORDERS that the claims administrator must not make any payment to the cy pres beneficiary until the Court approves the final distribution.

The court ORDERS that the claims administrator must continue to hold the 10% of attorneys fees until the Court approves the final distribution.

The Court sets this matter for an Order to Show Cause why sanctions should not be imposed for failure to comply with a Court Order. Order to Show Cause Re: failure to file a declaration with an accounting of the settlement funds. is set for 07/27/2026 at 02:30 PM in Department 21 at Rene C. Davidson Courthouse.

Failure to comply or appear may result in sanctions pursuant to one or more of the following: CRC 2.30, CRC 3.1340, CCP 177.5, CCP 575.2, CCP 583.150, CCP 583.360, CCP 583.410, CCP 583.420, CCP 583.430, and Government Code Section 68608.
