Procedural History 18 1) The parties are Petitioner Allison Padua (Mother) and Respondent Ryan Tolentino (Father). They 19 share three minor children named Roman Tolentino (04/24/15); Alyssa Tolentino (02/23/17); and 20 Aubrey Padua (04/15/18). 21 2) On January 12, 2023, the Juvenile Court issued an exit order, which provides that Mother has sole 22 legal and sole physical custody of the three minor children. Father was not awarded any 23 parenting time with the minor children. (See order filed 01/12/23). 24 3) On February 23, 2026, Father filed a Request for Order seeking a modification of the existing 25 visitation orders.
In particular, Father is asking this Court to order parenting time to Mother on 26 the 2nd, 4th, and 5th weekends from Friday after school to Monday morning to school. 27 4) On March 20, 2026, Mother filed a Responsive Declaration in which she asks this Court to deny 28 Father’s requests. 29
1 5) On March 20, 2026, Father filed an additional declaration, which has been read and considered by 2 this Court. 3 6) On March 24, 2026, Father filed another declaration, which has been read and considered by this 4 Court. 5 7) On March 30, 2026, this Court held a “Readiness” hearing and set the matter for FCS Mediation 6 to occur on April 6, 2026 and set the matter for return hearing on June 18, 2026. 7 8) On June 12, 2026, Father filed a Supplemental Declaration, which has not been read, nor has it 8 been considered by this Court. 9 9) On June 16, 2026, the parties submitted a Stipulation and Order regarding Child Custody and 10 Visitation, which partially resolves some of the issues pending on June 18, 2026. 11 B.
Findings and Order 12 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 13 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in 14 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 15 child(ren) is the United States. 16 2) The parties are ordered to appear. 17
