Motion for Terminating Sanctions Re: Nora Magallanes
The unopposed motion by defendant Edgard Jouseph Quinnones Carrasquillo for an order imposing terminating sanctions against plaintiff Nora Magallanes as a sanction for Plaintiff’s failure to comply with the court’s written orders dated February 18, 2026, requiring Plaintiff to provide verified responses to Defendant’s Special Interrogatories, Set Two, and Request for Production of Documents, Set Two, is GRANTED. Defendant served Plaintiff with notice of the court’s orders. (Matthew C. Jaime Decl., Ex. 12.)
It is undisputed Plaintiff has not provided Defendant with responses to the special interrogatories and request for production of documents. (Jaime Decl., ¶ 14.) By failing to file written opposition, Plaintiff has not provided any explanation for her willful failure to comply with the orders to provide discovery and therefore the Court concludes it is unlikely a lesser sanction would be effective.
In accordance with Code of Civil Procedure section 2023.030, subdivision (d)(3), the complaint by plaintiff Nora Magallanes against Defendant is dismissed with prejudice.
