Motion for Entry of Judgment Pursuant to Stipulation
TENTATIVE RULING:
Plaintiff Hillsdale Property San Mateo LP’s unopposed Motion for Entry of Judgment is GRANTED as to defendant Dennis Santos.
Plaintiff is reminded that exhibits must be properly bookmarked. That is, “electronic exhibits must include electronic bookmarks with links to the first page of each exhibit and with bookmark titles that identify the exhibit number or letter and briefly describe the exhibit.” (Cal. Rules of Court, rule 3.1110(f)(4); see also San Mateo County Superior Court, L.R. 3.3 [“Failure to bookmark exhibits to electronically filed documents may result in rejection of the party’s efiling by the Clerk of the Court or in continuance of the hearing by the Court on the related motion.”].)
Plaintiff’s Community Manager, Jonnah Mae Patague, states that on April 10, 2026, the parties reached a settlement and entered into a stipulation by which, among other things, defendant would make payments to plaintiff beginning on April 15, 2026. (Patague Decl. ¶¶ 4, 6.) Defendant made the first payment of $2,979.94 on April 18, 2026, but failed to make the second payment of $4,000.00. on or before April 30, 2026, by 5 p.m. (Id., ¶¶ 12-13.)
Defendant’s failure to make the second payment entitles the plaintiff to retake possession of the property, and to recover the balance due under the agreement, minus any credits for amounts previously paid. (Patague Decl., exh. 2, at p. 3, ¶ C.) In signing the Stipulation and proposed Order, the court noted that all requests for a money judgment must be brought in a properly noticed motion, citing L.R., 3.1200, et seq. The motion was accompanied by a notice, and served on defendant by overnight delivery.
Only defendant Dennis Santos, and not defendant Leticia Santos, executed the Stipulation. Dennis Santos’s failure to timely pay the amounts due is a material breach of the stipulation and order, pursuant to the parties’ agreement, the court will award a money judgment to plaintiff and against defendant Dennis Santos in the amount of $14,734.53. Plaintiff is ordered to submit a proposed judgment only as to defendant Dennis Santos.

If the tentative ruling is uncontested, it shall become the order of the court. Thereafter, plaintiff’s counsel shall prepare a written order consistent with the court’s ruling for the court’s signature, pursuant to California Rules of Court, Rule 3.1312 and Local Rule 3.403(b)(iv), and
