Plaintiff Umar N. Saeed, individually and as assignee of Naiel Enterprises (Plaintiff) commenced the action by filing a complaint on April 13, 2021. Unless Plaintiff can demonstrate the existence of an extension under Code of Civil Procedure section 583.330 or tolling under section 583.340, the deadline to commence trial pursuant to section 583.310 is April 13, 2026.
Given this pending deadline, the Court set a hearing on shortened time with a modified briefing scheduled. However, due to the shortened briefing schedule and because March 31, 2026 is a court holiday, the Court was unable to review the moving and opposing papers before preparing this tentative ruling. Appearances are therefore required.
The order setting this hearing expressly requires a motion to be filed and served on/or before 3/27/26. (Order on Ex Parte Application, 03/25/2026.) The Court has not and will not consider any arguments or evidence presented in the prior ex parte applications. If, at the hearing, the record indicates Plaintiff failed to file a timely motion on or before March 30, 2026, the hearing may be dropped for defective notice. If a timely motion is filed, the Court will consider any moving or opposing papers that were timely filed and any arguments presented at the hearing.
In advance of the hearing, the parties are directed to meet and confer as to whether there have been any extensions to or tolling of the deadline to commence trial and to select three proposed mutually agreeable trial dates between April 20, 2026[1] and July 7, 2026. If the Court finds good cause to specially set trial, the Court will consider a later trial date based on the mutual agreement of all parties.
This case has been assigned to Department 47 for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 47. Any party requesting an oral argument must contact the clerk at (916) 874-5487 and opposing counsel or parties in pro per by 12:00 p.m. on the court day before the hearing. If a proper request for hearing is not made, this shall become the order of the Court.
Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government Code section 68086 and California Rules of Court, rule 2.956. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
