(Defendant) CRS# 658439464030 in Department 18
Tentative Ruling - 06/15/2026 Patrick McKinney
The Hearing on Motion to Quash PLAINTIFFS COMPLAINT FOR LACK OF PERSONAL JURISDICTION; filed by VIKING PUMP, INC. (Defendant) CRS# 658439464030 scheduled for 06/16/2026 is continued to 09/22/2026 at 01:30 PM in Department 18 at Rene C. Davidson Courthouse.
Because this Tentative Ruling (TR) was published after 3:00 p.m. the day before the scheduled hearing 6/16/2026 hearing date, either party may timely contest this TR no later than Tuesday, 6/16/2026 at 12:00 p.m.
On defendant Viking Pump, Inc.s (Defendant) Motion to Quash Service of Summons for lack of personal jurisdiction, the Court CONTINUES the hearing to Tuesday, 9/22/2026 at 1:30 p.m. in Dept. 18 so that plaintiffs Nickie Wride and Katherine Wride (Plaintiffs) may conduct the jurisdictional discovery specified at their Supplemental Opposition at p. 3:11-27, specifically defendant Viking Pump, Inc.s (Defendant) distribution of ship pumps and replacement parts for ship pumps into California during the 1968 to 1985 period when Plaintiffs allege Mr. Wride encountered them while working at Californian shipyards and any marketing, advertising, technical service or sales support activities Defendant directed towards California during the relevant 1968 to 1985 period.
Defendant re-argues that the Motion to Quash should be granted because Plaintiffs have not identified specific Viking ship pumps by model number. However, Plaintiffs have identified specific ships on which Mr. Wride contends he encountered Viking pumps. The Court will therefore allow Plaintiffs to conduct appropriate written jurisdictional discovery in connection with those ships.
Plaintiffs may file and serve supplemental Opposition papers no later than 5:00 p.m. on Tuesday, 9/8/2026, and Defendant may file supplemental Reply papers no later than 5:00 p.m. on Tuesday, 9/15/2026. The parties shall provide Dept. 18 with paper courtesy copies pursuant to Local Rule 3.30(c) by 12:00 noon the day after service and filing.
The Court has no record that Plaintiffs initial Opposition papers served through File & ServeXpress were successfully filed with the Court. Therefore, the Court ORDERS Plaintiffs to refile their initial Opposition papers with the Court no later than Monday, 6/23/2026 at 1:30 p.m.
