The Hearing on Motion to Quash Service of Summons filed by IMI FABI (USA) INC. (Defendant) CRS# 847174616717 scheduled for 07/21/2026 is continued to 07/30/2026 at 01:30 PM in Department 18 at Rene C. Davidson Courthouse.

This tentative ruling addresses the respective Motions to Quash Service of Summons of each of defendants IMI Fabi (USA), Inc.; IMI Fabi, LLC; and IMI Fabi (Diana), LLC (collectively, “Fabi Defendants”)

The Fabi Defendants’ respective Motions to Quash Service of Summons are CONTINUED TO THURSDAY, 7/30/2026 at 1:30 p.m. in Dept.

18.

The Court continued the initial 7/9/2026 hearing date on this motion so that, per the Court’s 7/9/2026 Order, Plaintiffs could deliver paper courtesy copies to Dept. 18 of their late-served Opposition papers pursuant to the requirements of Local Rule 3.30(c), no later than the close of business on 7/14/2026. As of the close of business on 7/17/2026, Dept. 18 is unable to locate paper courtesy copies of Plaintiffs’ untimely Opposition papers.

The Court will afford Plaintiffs one final opportunity to provide Dept. 18 with paper courtesy copies of the voluminous Opposition papers pursuant to Local Rule 3.30(c) no later the close of business on Monday, 7/27/2026. If Dept. 18 has not received paper courtesy copies by 7/27/2026, the Court will be inclined to summarily grant the Fabi Defendants’ Motions to Quash based on Plaintiffs’ untimely service of its Opposition papers in advance of the initial 7/9/2026 hearing date and Plaintiffs’ failure to comply with Local Rule 3.30(c) and two (2) Court Orders. Instructions regarding proper delivery of paper courtesy copies are stated in the Court’s 7/9/2026 Order.

The Court requests that the Fabi Defendants not provide any further copies of their papers on the Motions to Quash. Dept. 18 has received two sets of paper courtesy copies of the moving papers on each of the three motions and has also received paper courtesy copies of the Reply papers.
