Ex Parte Application for Stay of Termination and Order Preserving Section 8 Assistance
26CV192372: RIZ vs HOUSING AUTHORITY OF THE COUNTY OF ALAMEDA, et al. 06/15/2026 Hearing on Ex Parte Application for Stay of Termination and Order Preserving Section 8 Assistance Pending Hearing in Department 20
Tentative Ruling - 06/15/2026 Karin Schwartz
Parties to appear.
On 6/9/26, Petitioner filed a petition for writ of administrative mandamus (CCP 1094.5) challenging a decision of the Housing Authority of the County of Alameda to set aside its decision terminating Petitioner's Section 8 Project-Based Voucher assistance and to reinstate the assistance retroactive to the effective date of the termination. Petitioner filed concurrently an ex parte application for a stay of the termination order together with a declaration of petition regarding ex parte notice.
The ex parte declaration re notice appears to be a type of form that has not, however, been completed. Accordingly, the Court lacks a demonstration of compliance with the notice requirements for ex parte relief. (See CRC 3.1204(b).)
