A person may not use an automated dial announcing device to make for solicitation purposes a telephone call in which the device plays a recorded message when the connection is completed unless:

(1)the recorded message is shorter than 30 seconds; or

(2)the device has the technical capacity to:

(A)recognize a telephone answering device on the called person's line; and

(B)terminate the call within 30 seconds.
