(a)The commission by rule shall establish reasonable and necessary fees for certification as an inspection station.

(b)The fees established under this section may not be less than:

(1)except as provided by Subdivision (2) or (3):

(A)$100 for certification until August 31 of the odd-numbered year after the date of appointment as an inspection station; and

(B)$100 for certification for each subsequent two-year period;

(2)if an applicant for certification as an inspection station has been convicted of a violation of this chapter relating to an emissions inspection under Subchapter F:
