§ 443.209 — SETOFFS

View on source(a)All mutual debts or mutual credits, whether arising out of one or more contracts between the insurer and another person in connection with any action or proceeding under this chapter, must be set off and only the balance shall be allowed or paid, except as provided by Subsection (b).
(b)A setoff may not be allowed in favor of any person if:
(1)the obligation of the insurer to the person:
(A)would not, at the date of the commencement of the delinquency proceeding, entitle the person to share as a claimant in the assets of the insurer; or
(B)was purchased by or transferred to the person:
(i)after the commencement of the delinquency proceeding; or
