(a)The department, subject to reasonable rules and guidelines, may:
(1)inspect documents and records used by data sources that are required to compile data and reports; and
(2)compel providers to produce accurate documents and records.
(b)The department may enter into a memorandum of understanding with a state agency, including the division of the commission responsible for the state Medicaid program, or with a school of public health or another institution of higher education, to share data and expertise, to obtain data for the department, or to make data available to the department. An agreement entered into under this subsection must protect patient confidentiality. Added by Acts 1995, 74th Leg., ch. 726, Sec. 1, eff. Sept. 1, 1995. Amended by:
