View on source(a)Notwithstanding Chapter 349, a creditor who contracts for, charges, or receives a charge relating to a credit transaction, other than interest or time price differential, that is more than that authorized by this chapter is liable to the consumer as provided by Section 349.003.
(b)For purposes of this section, a late fee, default charge, or delinquency charge is included as a charge relating to a credit transaction.
