View on source(a)The commission may impose a civil penalty against a person as provided by this subchapter only after a formal hearing as provided by Subchapter E, Chapter 571, Government Code.
(b)The commission shall base the amount of the penalty on:
(1)the seriousness of the violation;
(2)the history of previous violations;
(3)the amount necessary to deter future violations; and
(4)any other matter that justice may require.
