(a)As a condition for obtaining a driver training provider license, the provider must maintain a policy for the refund of the unused portion of tuition, fees, and other charges if a student, after expiration of the cancellation period described by Section 1001.401, does not enter the course or withdraws or is discontinued from the course at any time before completion.
(b)The policy must provide that:
(1)refunds are based on the period of enrollment computed on the basis of course time expressed in clock hours;
(2)the effective date of the termination for refund purposes is the earliest of:
(A)the last day of attendance, if the student's enrollment is terminated by the provider;
(B)the date the provider receives written notice from the student; or
