A filing instrument that is to take effect on or after the occurrence of a future event or fact in accordance with Section 4.053(a)(2) and for which the statement required by Section 4.055 is filed within the prescribed time takes effect on:
(1)the date, or the date and time, at which the event or fact occurs or is waived; or
(2)the specified date, the specified date and time, or the passage of the specified period of time after the occurrence or waiver of the event or fact. Acts 2003, 78th Leg., ch. 182, Sec. 1, eff. Jan. 1, 2006. Amended by:
