3-1088. Failure to pay fee; penalty; hearing; violation; classification A. A producer required to pay fees pursuant to section 3-1086 who fails to pay the fee shall be assessed a penalty of ten per cent of the total fee. The producer may request a hearing before the council to dispute or determine the amount of a fee or penalty imposed. B. The council shall hold a hearing if requested and no fee or penalty may be paid until the council, following the hearing, enters its order determining the amount of any fee or penalty. The producer shall pay the fee and the penalty assessed within ten days of notice of the council's decision. C. A person who knowingly fails to pay or remit any monies due or collected as required in this article is guilty of a class 2 misdemeanor.
