View on leginfo.ca.gov(a)If, at any time prior to issuance of a certificate of authority, the applicant’s average performance over any six-month period does not substantially equal or exceed the applicant’s projections for that period, the department may take any of the following actions:
(1)Cancel the permit to accept deposits and require that all funds in escrow be returned to depositors immediately.
(2)Increase the required percentages of construction completed, units reserved, or entrance fees to be deposited as required under Sections 1782, 1783.3, 1786, and 1786.2.
