Defendant Linda Doreen Gwozdz appeals from an order denying her request for resentencing under Penal Code section 1172.1.1 Gwozdz’s appointed appellate counsel filed a brief identifying no issues on appeal and requesting that we follow the procedures outlined in People v. Delgadillo (2022) 14 Cal.5th 216. (See People v. Rosemond (2025) 108 Cal.App.5th 667, 673 [Delgadillo applies to the denial of a request for resentencing under § 1172.1].)2 Gwozdz filed a supplemental brief in which she asserts the trial court erroneously denied her section 1172.1 resentencing request because, among other reasons, certain laws enacted after her conviction became final would potentially benefit her if the court was to resentence her. Because the order from which Gwozdz appeals is not appealable, we lack jurisdiction and therefore dismiss the appeal. FACTUAL AND PROCEDURAL SUMMARY In 2015, a jury found Gwozdz guilty of the second degree murder of her husband Patrick Duffey. (§ 187, subd. (a).) The jury also found true an allegation that in the commission of the murder Gwozdz personally and intentionally discharged a handgun causing great bodily injury and death to Duffey within the meaning of section 12022.53, subdivision (d). The court sentenced Gwozdz to prison for 40 years to life.
