On March 9, 2012, a jury found defendant and appellant Alex Jennings III guilty

of attempted willful, premeditated, and deliberate first degree murder (§§ 664, 187,

subd. (a), count 1);1 assault with a deadly weapon (§ 245, subd. (a)(1), count 2); and

active participation in a criminal street gang (§ 186.22, subd. (a), count 3.). The jury

additionally found true allegations that defendant committed the offenses in counts 1 and

2 for the benefit of a criminal street gang (§ 186.22, subd. (b)); that he personally used a
