On May 28, 1981, a jury found defendant guilty of robbery (Pen. Code, § 211,
count 2)1 and first degree murder (§ 187, count 3). In addition, the jury found true

allegations defendant was armed with (former § 12022, subd. (a)) and used (former
§ 12022.5) a sawed-off shotgun in his commission of both counts. The court sentenced
defendant to an indeterminate term of imprisonment of 25 years to life, plus nine years.
