Defendant and appellant Jerome Dwayne Peters was charged by information with
kidnapping (Pen. Code, § 207, subd. (a), count 1),1 making criminal threats (§ 422, count
2), and assault with a deadly weapon (§ 245, subd. (a)(1), count 3). The information also
alleged that he personally used a dangerous weapon in the commission of count 2, within
the meaning of sections 12022, subdivision (b)(1), and 1192.7, subdivision (c)(23).
Defendant entered a plea agreement and pled guilty to count 2 in exchange for the
