The court intends to grant the petition to terminate the Alfred J. and Gricelda C. Olivares Trust B dtd 09/22/99. (Probate Code §15403)
However, petitioner to discuss Article V §E ¶5 distribution on death of the surviving spouse:
Upon the death of the Surviving Spouse, the Trustee shall add to "Trust B" any portion of "Trust A" not disposed of and the Trustee shall distribute the remaining trust estate in equal shares to the Trustor's children JOHN J. OLIVARES and BERTHA A. BOURKE.
The trust appears to require modification if Trust B is terminated.
In addition, the Court requires a statement in writing by Surviving Spouse that Surviving Spouse will not alter and/or change the beneficiaries of Trust A to assure the remainder beneficiaries are not changed.
