Defendants Motion for a Protective Order is DENIED.
Defendant seeks a protective order that it not be required to produce the insurance policies requested by Plaintiffs in their Request for Production of Documents, Set Two, No.
75.
This motion is denied for the same reason that Plaintiffs motion to compel a further response to Request for Production Set Two, No. 75 (also heard this same day) is granted.
Defendant contends that if it is compelled to produce its insurance policies, its insurers may decline to renew those policies and Defendant may not be able to obtain replacement insurance. The Court, however, determines that the policies fall within the scope of discovery permitted by Code of Civil Procedure section 2017.210. Defendants concern about the potential ramifications of disclosure of this information on its ability to retain or obtain insurance coverage does not fall within the traditional bases for the granting of a protective order. Defendant does not demonstrate, for example, that producing the policies would be burdensome or expensive, or that they contain confidential information.
No monetary sanctions are available to anyone. Based on the tangential relevance of the insurance policies to the claims alleged by Plaintiffs in this case, and the lack of clarity about the potential scope of discovery permitted by Code of Civil Procedure section 2017.210, the Court determines that Defendant acted with substantial justification in filing this motion seeking the Courts determination of this issue.
