Tentative Ruling
The motions are DENIED AS MOOT. Defendant Ford Motor Companys served verified responses on November 26, 2025. Although the Court has the discretion to award sanctions (Cal. Rules of Court, rule 3.1348, subd. (a)), it declines to do so here. In this case, the motions were filed on November 20, 2025, one day after the discovery responses were due. Defendant promptly served responses within a week of being served with the motions, then served the verifications within two weeks of service of the responses. The plain language of the Code provides that Defendant has waived objections (Code Civ. Proc., §§ 2030.290, subd. (a), 2031.300, subd. (a), 2033.280, subd. (a)). To the extent Defendant has asserted objections, Defendant may seek relief of court on the waiver issue.
Plaintiffs counsel is ordered to give notice of the Courts ruling.
