Hearing: Motion to Vacate Order of Dismissal

Date: June 9, 2026

On May 19, 2025, Plaintiffs filed a notice of conditional settlement. The Court subsequently ordered the matter be dismissed on December 23, 2025, absent a motion to vacate the Court’s order. (Cal. Rules of Court, rule 3.1385.) The dismissal date was extended due to the filing of a petition to approve a minor’s compromise. Dismissal is now set for June 23, 2026. A hearing on the petition for approval of the minor’s compromise is set for June 12, 2026. Once the Court approves the minor’s compromise, a follow-up hearing will be required to ensure the funds have been placed into a blocked account. Plaintiffs ask the Court to set aside its May 27, 2025 order of dismissal to allow the minor’s compromise to be finalized.

ORDER (PROPOSED)

The motion is granted. The Court vacates its order dated May 27, 2025, and sets a new dismissal date of December 11, 2026.
