REQUEST FOR ORDER RE: ISSUE WRIT OF EXECUTION TENTATIVE RULING Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the Court makes the following findings and orders: A. Procedural History 1) The parties are Petitioner Keith Richardson and Respondent Lachon Richardson. 2) On 2/28/25, the Court entered judgment, which includes a provision for Petitioner to pay Respondent $160,000 total in $3,500 monthly payments due on the 1st of each month until the balance is paid in full. This provision is contingent on Petitioner’s accounting documents showing that business earnings from Keith’s Chicken and Waffles were no greater than 5% above $100,000 annually for 2023, and Petitioner was to provide the accounting paperwork within 30 days. 3) On 12/17/25, Petitioner filed a Request for Order seeking to set aside judgment under Code of Civil Procedure section 473 and Family Code section 2122. Petitioner asserts that he lacks the ability to comply with the payment terms of the judgment because his income is generated from a small business with limited liquid funds. Petitioner further asserts the Court relied on false information when entering judgment because Respondent represented that she has a $3,000 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 monthly rent obligation despite living with her parents rent free. Petitioner states the motion is based on, “actual fraud, perjury, failure to disclose material facts, and attorney abandonment.” 4) On 2/23/26, Respondent filed a Motion to Strike Petitioner’s Request for Order pursuant to Code of Civil Procedure section 436. Respondent’s request is based on a lack of supporting documents and sufficient facts and lack of proper service under Code of Civil Procedure section 1010 and California Rules of Court, rule 5.92(b)(1). Attached to Respondent’s Motion to Strike are the documents with which Respondent was served, and Petitioner’s supportive declaration (which was filed with the Court) is not attached. 5) At the prior 3/3/26 hearing, the Court made a finding of good cause to continue the hearing to 7/7/26 at 9 AM in Dept. 403 for proper service to be effectuated and ordered as follows: a. The Court declines to exercise its discretion under Code of Civil Procedure section 436; Respondent’s Motion to Strike is therefore DENIED. b. At least 16 Court days prior to the next hearing date, Petitioner shall reserve on Respondent the 12/17/25 Request for Order and supportive declaration using a service method authorized by the Code of Civil Procedure and then file form FL-335 (Proof of Service) with the Court confirming service was effectuated. c. At least 9 Court days prior to the next hearing date, Respondent may file a Responsive Declaration. d. Procedural History 1) The parties are Petitioner Jesse Koniuk and Respondent Rachel M. Koniuk (Rachel Gelb). 2) On 1/12/26, Respondent filed a Request for Order seeking $25,000 in Family Code section 271 sanctions. Respondent asserts that Petitioner has repeatedly violated the Court’s prior custody/visitation and financial orders. Respondent alleges uncooperative behavior by Petitioner that is not indicative of an intent to co-parent. Respondent also alleges conduct by Petitioner that is delaying the dissolution process. Respondent attaches text messages and Talking Parents communications. The matter was set for hearing on 4/7/26. 3) On 3/26/26, the parties filed a Stipulation and Order continuing the hearing from 4/7/26 to 5/14/26. 4) On 4/29/26, Petitioner filed a Responsive declaration and supportive pleading in opposition to Respondent’s Request for Order. B. Findings and Order 1) Respondent’s request for $25,000 in Family Code section 271 sanctions is DENIED. B. Findings and Order 1) Respondent’s request for child support is GRANTED in accordance with the XSpouse report attached hereto and incorporated herein. Child support in the amount of $2691.00 per month, payable by Petitioner to Respondent, shall commence on June 1, 2026. The Court finds Petitioner paid direct support for the minor children from date of separation to the present; therefore, the Court DENIES Respondent’s request to set child support retroactive to November 7, 2025. 2) Respondent’s request for spousal support is GRANTED in accordance with the XSpouse report attached hereto and incorporated herein. Spousal support in the amount of $2852.00 per month, payable by Petitioner to Respondent, shall commence on June 1, 2026. The Court finds Petitioner 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 paid direct support to Respondent from the date of separation to the present; therefore, the Court DENIES Respondent’s request that spousal support be retroactive to the date she filed her Request for Order (i.e., February 4, 2026). 3) In addition to the child support and spousal support amounts set forth above, Petitioner shall pay Respondent bonus child and spousal support pursuant to the Smith/Ostler bonus table attached to the XSpouse report. Bonus support shall be paid within 10 days of receipt of any bonus amount by Petitioner. 4) Both parties shall split any unreimbursed medical costs and childcare costs related to employment with 60% allocated to Petitioner and 40% allocated to Respondent. 5) In light of the child and spousal support orders made herein, Petitioner is prohibited from seeking Watts charges and Epstein credits from Respondent for her exclusive use and possession of the family home from the date of separation through May 31, 2026. 6) Respondent’s request for Family Code section 2030 attorney’s fees and costs is GRANTED in the amount of $35000.00. The Court finds there is a significant disparity of access to funds. The Court further finds Respondent has need and that Petitioner has the ability to pay both parties fees and costs. $35000.00 is reasonable and necessary. 7) Petitioner’s request that Respondent be given exclusive use and possession of the family residence located at 466 19th Avenue, San Francisco, California 94121 is GRANTED. 8) Petitioner’s Request that Respondent be ordered to pay the carrying costs associated with 466 19th Avenue, San Francisco, California is GRANTED.
