On April 30, 2025, Kendrick Hardy filed this action pursuant to the Song-Beverly Consumer Warranty Act, Civil Code sections 1790, et seq., arising out of his purchase of a 2020 Ford Fusion. Plaintiff filed a first amended complaint (FAC) on January 2, 2026.
Defendant Ford Motor Company (Ford) now demurs to the sixth cause of action in the FAC for Fraudulent Inducement—Concealment, on the grounds that it fails to state a cause of action and is uncertain. Plaintiff filed a notice that he does not oppose the demurrer.
Ford’s unopposed demurrer to the sixth cause of action for fraudulent concealment is sustained without leave to amend.
Ford shall file and serve its answer to the remaining causes of action alleged against it in the FAC within by June 25, 2026.
