On May 5, 2026, the court published a tentative ruling continuing the hearing on Plaintiffs motion for preliminary approval to allow the parties to address certain issues in the settlement agreement and proposed notice. The case management conference was continued to coincide with preliminary approval hearing. The tentative ruling was not contested and adopted. Plaintiff was ordered to make supplemental filings at least 5 court days before the continued hearing on May 27, 2026.
On May 19, 2026, Plaintiff filed a joint status conference statement expressing an intention to comply with the court's ruling, but Plaintiff did not timely file a revised proposed order or declaration addressing the issues. The hearing was continued again, and Plaintiff ordered to file the documents by June 3, 2026. No filings have been made.
The court will continue the hearing once more, to June 24, 2026. If Plaintiff does not file the requested documents by June 16, 2026, the motion for preliminary approval will be dropped. If the supplemental preliminary approval documents are not forthcoming, the parties must file a joint status update by June 16, 2026.
CONTESTING THE TENTATIVE RULING: If the parties do not contest, the tentative ruling will be adopted. Any party wishing to contest must notify the court by email at Dept18@alameda.courts.ca.gov and notify all opposing counsel or unrepresented parties by 4pm the day before the hearing.
